Now you will get leave for period pain! Petition filed in Supreme Court

In the petition, there has been a demand for menstrual pain leave for female students and working women in India. The petition has demanded the Supreme Court to issue directions to the state governments to frame rules for menstrual pain leave for women.

A petition has been filed in the Supreme Court regarding the demand for leave for period pain.

A demand has been made to implement Section 14 of the Maternity Benefit Act, 1961 effectively.

New Delhi.  A petition has been filed in the Supreme Court on Tuesday regarding leave for the pain related to menstruation of women. The petition sought directions for effective implementation of Section 14 of the Maternity Benefit Act, 1961. In the petition, there has been a demand for menstrual pain leave for female students and working women in India. The petition, filed by advocate Shailendra Mani Tripathi, has sought the Supreme Court to issue directions to state governments to frame rules for menstrual pain leave for women.

The petition has also sought directions to effectively implement Section 14 of the Maternity Benefit Act, 1961, which appoints inspectors to enforce those provisions. According to the petition, Bihar is the only state which provides special menstrual pain leave under the 1992 policy. In such a situation, denying women menstrual pain or menstrual leave in other states of the country is a violation of their right to equality under Article 14 of the Constitution.

According to the petition, while demanding the intervention of the Supreme Court in this matter, it said that there is a lack of legislative will regarding menstrual pain leave. Because two private member bills were introduced in the Lok Sabha on related matters. But both the bills have lapsed. The petition also states that the demand for leave in the period of menstruation has been ignored knowingly or unknowingly by the Societies, Legislature and other stakeholders, barring some organizations and state governments.

According to the petition, where some Indian companies such as Evipan, Zomato, Byju's, Swiggy, Mathrubhumi, Magzter, Industry, ARC, Flymybiz and Gozoop offer paid period leave. The same UK, China, Japan, Taiwan, Indonesia, South Korea, Spain and Zambia already provide menstrual pain leave in some form or the other.
