Same-Sex Marriage: Controversy is increasing in the Supreme Court on the demand for legality of same-sex marriage. The Central Government filed a petition in this regard today, in which questions have been raised on the demand for its validity. The court has agreed to hear the petition against the Centre's objection. Several petitions have already been filed in the Supreme Court on the legality of same-sex marriage, on which a five-judge bench will hear on April 18.
The Gujarat-Madhya Pradesh government has also filed an application in the court against the petitions demanding validity. The Central Government, Gujarat and Madhya Pradesh and NCPCR also demanded a hearing on the applications on Tuesday. In protest against these petitions, the Center said in an affidavit that it is an 'urban elite type' concept.
Central government strict in its petition
The central government also said that the court cannot write a complete law to recognize same-sex marriage, as creating a new social institution is outside the jurisdiction of the court. Any decision of the Supreme Court recognizing same-sex marriage would virtually mean rewriting the law relating to it. The Center said in its petition that the court should refrain from passing any such order. The Center said that proper authority, proper legislature exists for this. In view of the fundamental social values of these laws, it has to pass from bottom to top and through the law to be valid.
A five-judge bench will hear in the Supreme Court
A five-judge bench in the Supreme Court will hear petitions seeking legal recognition of same-sex marriage in the country from Tuesday. The matter will be heard on April 18 before a bench of Chief Justice DY Chandrachud and Justices SK Kaul, S Ravindra Bhat, PS Narasimha and Hima Kohli. On March 13, the matter was referred to a larger bench.
