What is the ninth schedule of the constitution, why is it in discussion again regarding reservation

Talking about the 9th schedule of the constitution, it was added through the first constitutional amendment of the year 1951. There cannot be judicial review of the laws involved in this, that is, the top courts of the country cannot review it.

Chhattisgarh Chief Minister Bhupesh Baghel has written a letter to Prime Minister Narendra Modi regarding reservation. In this letter, he has requested PM Modi to take an important decision regarding the change in reservation . He said that the amendments made by our government to increase the reservation in the state should be included in the Ninth Schedule of the Constitution. Let us tell you that the Baghel government has amended the provisions of reservation to give 76 percent reservation in the state. However, the Governor has not yet given his approval to it.

Under this, a provision has been made for 13 percent reservation for Scheduled Castes, 32 percent for Scheduled Tribes, 27 percent for OBCs and 4 percent for economically weaker sections. It is worth mentioning that former National President of Congress Rahul Gandhi has also talked about the share according to the population. Even on Monday, Rahul has demanded that the census should be done soon and caste census should be included in it. Now let us tell you that what is the 9th Schedule of the Constitution and what would happen if any amendment was included in it?

Importance of 9th Schedule of the Constitution?

Talking about the 9th schedule of the constitution, it was added through the first constitutional amendment of the year 1951. There cannot be judicial review of the laws involved in this, that is, the courts of the country cannot review it. This protection is available under Articles 31A and 31B of the Constitution. For this reason, there has been a demand for including the issues related to reservation in the 9th Schedule of the Constitution for a long time. Many state governments have increased it despite the Supreme Court setting a limit of 50 per cent reservation.

13 laws included in the ninth schedule

At present 13 laws are included in the Ninth Schedule of the Constitution. These laws were added in the year 1951. Among the laws that were included in the 9th schedule, land reform and abolition of landlordism were prominent. At present there are 283 laws in the Ninth Schedule. The special thing about the ninth schedule is that if any law is declared unconstitutional. So if that law is put in the ninth schedule, then it is considered valid.

Chhattisgarh has elections next year

After Bhupesh Baghel wrote a letter to the Prime Minister, the ninth schedule has again come into the limelight. Elections are to be held in Chhattisgarh at the end of this year, in such a situation, Baghel's move is being linked to it. At the same time, amidst the efforts of opposition unity before the Lok Sabha elections, Rahul is also trying to woo voters through social justice by talking about increasing the reservation limit. There are many regional parties including RJD, JDU in favor of caste census.
