Ariha Case: You will remember the case of Ariha Shah. The 28-month-old girl, who was allegedly abused by her parents, was taken to the hospital for treatment, but the girl was not recovered and is currently in the custody of the German Youth Service. The case was going on in a German court. The court gave its verdict and refused to give the custody of the child to the parents. After this important decision of the court, the girl child will remain in the custody of the youth service. Meanwhile, her parents are making all efforts to get the custody of the girl child.
Rejecting Dhara and Bhavesh Shah's application to return the baby girl directly to them or at least hand over to a third party, the Indian Welfare Services, the court handed over custody of Ariha to the Jugendamt (German Youth Care) and ruled that The parents have no right to take decisions regarding the child. In this matter, the Ministry of External Affairs had also written a letter to the German authorities.

On 3 June, Ministry of External Affairs spokesperson Arindam Bagchi sent Ariha to India as soon as possible as an Indian citizen, which is the right of the girl child. Earlier, 59 MPs from 19 parties including BJP, Congress wrote a joint letter to German Ambassador to India, Philipp Ackermann. It was demanded that every effort should be made to bring Ariha back to India. The court has declared Germany's Central Youth Welfare Office as the provisional guardian of the girl child. Now the final decision on the child has to be taken by this authority.
Parents demand to send Ariha to India
Ariha's parents Dhara and Bhavesh had applied in the court for Ariha's custody, but later withdrew it. Then he filed an application and demanded that the custody of the child should at least be handed over to the Indian Welfare Services. Apart from this, he had demanded the court to restore the parental custody of the girl and told that Ariha will be kept in a foster home run by Ashok Jain in Ahmedabad. The family's plan was that they would return home with the girl child.
Permission to meet twice a month till the age of three
The court accepted that in April 2021, while taking a bath, the girl's head and back were hurt. Later in September, injury marks were found in the private part of the girl. After this, Dhara and Bhavesh took her to the hospital, but the hospital informed the child welfare and then the same child care center took the child in their custody. The court is apprehensive that if the custody of the child is given to the parents, then she may have to face harassment again. Meanwhile, the court has allowed him to meet the girl child twice a month till she turns three years old.
