Aurangzeb DP Controversy: What a big crime to put Aurangzeb's DP, what does the law say?

The controversy regarding Mughal ruler Aurangzeb in Maharashtra is not taking the name of stopping. Now the latest controversy has come to the fore regarding the installation of Aurangzeb DP Controversy . A case was registered against a person in Navi Mumbai because he had put Aurangzeb's picture in his WhatsApp DP. The name of the accused is Mohammad Ali.

Following the complaint of Amarjit Surve, a resident of Navi Mumbai's Vashi area, the police arrested the man who posted Aurangzeb's DP, however, he was released after questioning. Now the legal dispute has started on the whole matter. How legal was the arrest of Muhammad Ali?

Under which section was the arrest made?

The complainant said that a screen shot of Aurangzeb's DP had come on his mobile. After investigation, the person who installed the DP was contacted and he was asked to change the DP, but when he did not change the DP, a case was registered against him in the police station.

After questioning the police, it was found that Mohammad Ali works in a mobile service provider's shop. After the arrest, the police registered a case against him under sections 298 and 153-A .

Senior advocate Sanjay K Chadha says – Section 298 deals with uttering words with intent to hurt religious feelings while 153-A deals with promoting enmity between different groups on grounds of religion, race, place of birth, residence .

How big a crime is it to put Aurangzeb's DP?

According to senior advocate Sanjay K Chadha, putting Aurangzeb's DP is not a crime. They say Aurangzeb is a part of our history. His pictures are printed in the course books. There was a road named after him in Delhi. Aurangzeb's rule and his story are included in our education, so will a case be filed against those who studied him, printed his photo in books?

Senior advocate Sanjay K Chadha even says that many times a case is registered against someone wrongly and arrested as an accused. In this case too, if arrest has taken place only because of applying DP, then it is wrong. There was no need to arrest here just because of this.

Tension spread in the name of Aurangzeb in Maharashtra

In Ahmednagar, Maharashtra, there was a controversy over waving posters of Aurangzeb during a rally in the past. The police had also arrested two people and registered a case against four people. After this, tension spread in many cities of the state over the alleged glorification of Mughal emperors Aurangzeb and Tipu Sultan. Kolhapur bandh was called on last 7th June.
