Medical Termination of Pregnancy Act is once again in discussion. The reason is a historic decision of the Supreme Court. In which the Supreme Court has allowed a rape victim to abort a fetus of 28 weeks. This is the first case of its kind. This act allows termination of pregnancy up to a maximum of 24 weeks with the approval of the medical board. In this way, this case became the first and unique of the country.

For the first time this act was implemented in the country in 1971, there was a provision in this act that a married woman could get an abortion done. The gestation period could be up to a maximum of 20 weeks. Although there were some conditions in this. If the pregnancy is of 12 weeks then the consent of a doctor was necessary. In case of 20 weeks of pregnancy, the opinion of two doctors was necessary. In the year 2021, the Central Government amended the Medical Termination of Pregnancy Act i.e. MTP. After its implementation, unmarried women were also allowed abortion with certain conditions.

These are the rules of abortion

Consent of one doctor for pregnancy up to 20 weeks, consent of two doctors is considered necessary for 20-24 weeks of pregnancy. A new system was also added in which if the pregnancy is more than 24 weeks then the report of the medical board is necessary and the permission of the court is necessary. In this, the Act of the year 2021 allows even in case of rape victim or fetus being abnormal. In both the Acts, there is a provision of punishment for disclosing the identity of the victim woman. In the Act of 1971, there was a fine of one thousand rupees and now along with the fine, there can be a punishment of one year.

Delhi High Court gave permission

Earlier in the year 2021, the Delhi High Court had given permission to abort a 22-week-old foetus, which was abnormally deformed. The latest case is related to Gujarat. A 25-year-old woman was raped in January. She became pregnant. When the woman recovered, she started visiting the hospitals. When things did not work out, the High Court was reached. The Gujarat High Court dismissed his petition.

Pregnancy reminds me of the wounds of rape

On August 19, the woman reached the Supreme Court. On August 21, Justice B.V. Nagaratna and Justice Ujjwal Bhuiyan's bench not only allowed abortion while hearing, but Justice Nagaratna also said that such pregnancy reminds of the wounds of rape. This increases the pain of the victim. Mental health is affected. It is already broken. The Supreme Court also commented on the decision of the Gujarat High Court in this matter. Justice Nagaratna said that in such a sensitive matter, how can you give a date after 12 days, when every day is getting heavy for the victim.
