There is no mention of sexual offenses against men in the new law of the Modi government.

In place of the IPC and CrPC, the central government has presented the bill of the proposed law in the Lok Sabha, defining rape as an act committed by a man against a woman or a child.

Instead of the Indian Penal Code and the Criminal Code, the Central Government has introduced a new bill in the Lok Sabha. Discussions have started regarding this bill. One thing has emerged from this round of discussions that in the bill proposed by the government, there is no provision of punishment for unnatural sex crimes committed against men.

Men are protected from sexual offenses under Section 377 of the IPC, but in the proposed law of the Central Government, no provision has been made for punishment for unnatural sexual offenses against men. In the law proposed by the central government, to define sexual crimes like rape, it has been told only as an act committed by a man against a woman or a child.

What does today's law say?

According to the law at present, sexual offenses against men come under section 377. Section 377 of the Indian Penal Code (IPC) states that whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with imprisonment for life, or with imprisonment of either description for a term which may extend to two years, or with both. It can also be extended and punishment up to ten years and fine can also be imposed.

On 6 September 2018, the Supreme Court unanimously gave a historic verdict on Section 377 of the IPC. The Supreme Court had decriminalized homosexual relations between consenting adults. However, non-consensual acts against men, such as unnatural sex, are still considered offenses under section 377. But this is not so in the proposed law of the Center.

Crackdown on crime against women

Under the proposed bill, under the Indian Code of Justice, marrying any woman by concealing her identity or having sex with the promise of marriage will be punishable if the law comes into force. Not only this, having sex by telling false promise of promotion, job or any other lie will lead to imprisonment of up to 10 years.

This is the first time when a special provision regarding such crimes has been proposed in view of the protection of women. According to experts, if the Standing Committee does not make any changes in this and it is implemented with the same interpretation, then this provision will prove to be a weapon against Love Jihad. However, he also says that it is in the interest of women, because such cases come to the fore every day, where women are victims of sexual exploitation on fake names or promises.
