'We can just say Happy Diwali', ban on firecrackers will continue in Delhi, SC did not give relief


The Supreme Court has made it clear that all types of firecrackers will be banned in the capital Delhi on the occasion of Diwali. Be it green or normal. The bench of two judges said that nothing would be achieved by merely taking action against those who burst firecrackers. We have to get to the bottom of this. The Solicitor General said that the police will visit all the manufacturing centers and ensure that firecrackers are not being manufactured.

Diwali is about to come and like always, this time too there is a debate on firecrackers. There will be Green Diwali in the capital Delhi this year also. The Supreme Court has maintained the ban on firecrackers in Delhi. The court has also not approved green firecrackers. The Supreme Court has refused to approve the production and sale of green firecrackers. The court ordered strict implementation of the 2018 restrictions. Along with this, the Supreme Court rejected the petition demanding manufacturing and use of firecrackers using barium material in the country.

The Supreme Court has refused to interfere in the Delhi government's decision to ban the use of firecrackers in Delhi before Diwali. Green cackers can be used in other states in the country where governments have approved them. In states where there is a complete ban, burning of firecrackers is not allowed. The manufacture and sale of barium containing and other joint crackers including ladia will not be approved. Justice AS Bopanna, while reading the operative part of the judgment, said – “We can only say Happy Diwali.”

BJP leader Manoj Tiwari had also filed a petition

Last week, the bench of Justices AS Bopanna and MM Sundaresh had reserved the verdict after hearing the case in detail. Many petitions were filed in the court to lift the ban on firecrackers. Among these, one petition is also of Bharatiya Janata Party leader Manoj Tiwari. He had filed a petition challenging the complete ban on firecrackers during Diwali celebrations in Delhi in 2022. During the hearing, the court questioned whether he could serve as a superior authority over the Council of Scientific and Industrial Research? And also commented that it would take someone to trust the primary institutions.

Nothing will be achieved by merely taking action against those who burn firecrackers: SC

The Supreme Court made it clear that all types of firecrackers are banned in Delhi – whether green or normal. Additional Solicitor General Aishwarya Bhati told the court that Delhi Police has not issued any permanent license for firecrackers since 2016. He also told the court that all permanent fireworks manufacturing licenses have been canceled and the police will inspect all the premises of the licensees and ensure that firecrackers are not being manufactured in the capital. The court remarked that merely punishing the firecrackers is not enough and the authorities will have to go to the source of these firecrackers.
