Supreme Court's decision on Article 370...What did Kashmiri Pandits get?

 


The Supreme Court has upheld the decision of the Government of India neutralizing Article 370. The five-member Constitution bench of the court today gave its verdict on the case pending for more than four years. Apart from Chief Justice DY Chandrachud, the judges who delivered the verdict included Justice Sanjay Kishan Kaul, Justice Surya Kant, Justice BR Gavai and Sanjeev Khanna. Most of the things the court said may be about Article 370 and Article 35A, but the court has also given some important orders in its decision regarding Kashmiri Pandits.

Senior Supreme Court Justice Sanjay Kishan Kaul also mentioned the displacement of people of Kashmir and subsequent terrorism in his decision. The court has talked about forming a fact finding committee regarding this. In its decision, the court said that there is a need for a fact finding committee regarding the injustice and cruelty done to Kashmiri Pandits. If the government moves in this direction then it will be an important step regarding the rights of Kashmiri Pandits.

'...there was no migration of Kashmiri Pandits'

There is often pressure on the Bharatiya Janata Party government that they should take concrete steps for the return of Kashmiri Pandits. The government had said last year that after the abrogation of Article 370, no incident of any Kashmiri Pandit migrating from the valley has come to light. At the same time, the government also said that under the Prime Minister's Development Package, about 55 hundred Kashmiri Pandits have been given jobs in different departments of the Jammu and Kashmir government in the Kashmir Valley.

Who is Justice Sanjay Kishan Kaul?

Justice Sanjay Kishan Kaul is currently the second most senior judge in the Supreme Court. Justice Kaul belongs to a Kashmiri family. He started his professional career in the year 1987. In February 2017, he was appointed judge of the Supreme Court. He is going to retire this month.
