The bench of Justice MM Sundaresh and Justice SVN Bhatti was hearing the case. While giving the verdict, the two-member bench of judges said that the mistake committed due to the procedure in this case is possible to be rectified.

The Supreme Court has also said that the concerned authorities are allowed to prosecute by following the prescribed procedure. The court has given approval to prosecute the accused in this case under the Unlawful Activities (Prevention) Act i.e. UAPA Act.
