Atul Subhash Tragic Suicide Case, 'Nyay Prayaas Foundation' Demands Urgent Reforms in Indian Justice System


Atul Subhash Sucide Case:
 The country is currently in deep shock due to the suicide of Bangalore tech engineer Atul Subhash. Apart from social media, the country's big news channels are also raising their voices about this tragic incident. From the common people of the country to journalists and many NGOs working in the interests of men have demanded changes in the country's judicial system.

Nyay Prayaas Foundation (NPF) Demands Urgent Reforms in Indian Justice System Following Bengaluru Techie Atul Subhas' Tragic Suicide Case

Bengaluru techie Atul Subhas tragic suicide case highlights the failure of justice in our country, where the very institutions meant to provide protection and support instead become tools for persecution. His story is not an isolated incident, but rather a symptom of a broader problem - the deliberate systematic ordeal designed to destroy men emotionally, socially, and financially.

NPF urges the government and judiciary to take immediate notice of this grave issue and take concrete steps to address the systematic problems that have led to such tragedies. It is imperative that we acknowledge the suffering of men in India and work towards creating a more just and equitable society for all. In this regard NPF proposes the following

1. Police and Judicial Reforms

NPF urges the government to reduce the involvement of Police machinery in matrimonial criminal litigation (498a, 323, 506 etc.) and lay guidelines to follow Provision of CrPC 200 (BNS 223) wherein pre-summoning evidence must be scrutinized by the judicial officer before summoning the accused. This will not only reduce the Police burden on FIR, Investigation and filing of Chargesheet but also at the same time reduce misuse and harassment for both parties. Furthermore, it is pertinent to mention this will reduce unnecessary burden on various High Courts and Supreme Court in the cases related to transfer petition and quashing petitions (CrPC 482 / BNSS 528).

2. Single window for All Matrimonial Litigations

Multiple litigations are filed during matrimonial discord in different Courts (Civil and Criminal). NPF demands all Cases under single CNR number providing the single

 window system in the lastly resided jurisdiction of the litigants. In this regard necessary guidelines and procedural changes to be issued for Family / JMFC courts as such power lies with Apex Court of India. This reform will ensure speedy trial and travelling litigants to attend multiple dates in different courts on India.

3. Proper implementation of Video Conferencing rules

Supreme court of India has issued guidelines and circulars to High Court to ensure hybrid mode and use of technology, which will not only lower the burden on courts and reduce physical appearance of the litigants. NPF demands High Courts to strict compliance to VC facility to be made available across India in all District court under their respective jurisdiction

4.Welfare of Child is Paramount in all Courts of Law

Society has faced disturbing consequences of matrimonial discord, but children are the worst sufferer. NPF demand Parental alienation must be reduce at the initial stages and mediation centers must ensure child visitations in early stage of matrimonial disputes, this will not only reduce the divorce rate but also help non – custodial parent to remain bonded with the alienated child. NPF further demands shared parenting guidelines and strict compliance of child visitation order by the Court to ensure the right of the children to have affection of both parents.
